Context

  1. Elections to 12 Rajya Sabha seats are scheduled for 16th October 2026.
  2. The election covers 10 seats in Uttar Pradesh, one each in Uttarakhand and West Bengal through a by-election.

Constitutional Composition

  1. Article 80 provides for the composition of the Rajya Sabha.
  2. The Constitution permits a maximum of 250 members, including up to 238 representatives of States and Union Territories and 12 nominated members.
  3. The present strength is 245 members, comprising 233 elected representatives and 12 nominated members.
  4. The President nominates 12 members with special knowledge or practical experience in literature, science, art and social service.

Electoral Mechanism

  1. Rajya Sabha elections are indirect. Citizens do not directly elect candidates to these seats.
  2. Representatives of the States are elected by the elected members of the respective State Legislative Assemblies.
  3. The representatives of each Union Territory in the Rajya Sabha are indirectly elected by members of an electoral college specially constituted for the purpose.
  4. Elections are conducted through proportional representation by means of the Single Transferable Vote (STV).
  5. Under STV, electors indicate their preferences among candidates, with votes transferred according to the prescribed counting procedure.
  6. Rajya Sabha elections use an open-ballot system.
  7. Nominated members of State Legislative Assemblies do not participate in these elections.

Tenure and Continuity

  1. The Rajya Sabha is a permanent House and cannot be dissolved.
  2. Each member normally serves a six-year term.
  3. One-third of the members retire every two years, ensuring periodic renewal while maintaining continuity.
  4. When the House was initially constituted, members were assigned staggered terms to establish this rotational arrangement.
